TERMS OF SERVICE

1. INTRODUCTION AND ACCEPTANCE Welcome to Tattoo Aspen by TrudyLines ("Company", "we", "us", or "our"). We provide a seasonal, appointment-only tattoo experience in Aspen, Colorado (the "Pop-Up"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Client", or "you") and the Company concerning your access to and use of our website, services, and physical studio space.

IMPORTANT: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 10). PLEASE READ THEM CAREFULLY. BY BOOKING AN APPOINTMENT OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

2. THE NATURE OF SERVICES
2.1. The Pop-Up Residency: Tattoo Aspen is a limited-time residency featuring international tattoo artists.
2.2. Independent Artists: You acknowledge that the tattoo artists operating at Tattoo Aspen are independent contractors and not employees of the Company. Tattoo Aspen provides the facility, management, and booking platform, but the artistic service is performed directly by the artist.
2.3. Artist Discretion: Artists reserve the right to refuse any design, placement, or client at their professional discretion.

3. BOOKING, DEPOSITS, AND PAYMENTS
3.1. Deposits: To secure an appointment, a non-refundable deposit is required. This deposit counts towards the final cost of your tattoo.
3.2. Non-Refundable Nature: Due to the exclusive and time-sensitive nature of the Pop-Up, ALL DEPOSITS ARE FINAL AND NON-REFUNDABLE. This applies even if you change your mind regarding the design or placement.
3.3. Payment Methods: The remaining balance is due immediately upon completion of the service. We accept major credit cards and cash.
3.4. Price Estimates: Any price estimates given prior to the session are non-binding. The final price depends on the size, detail, and time required for the final design on the day of the session.

4. CANCELLATION AND RESCHEDULING POLICY
4.1. Rescheduling: You may reschedule your appointment up to 48 hours prior to your scheduled time without penalty, subject to the artist's remaining availability during the Pop-Up dates.
4.2. Late Cancellation: Cancellations made within 48 hours of the appointment will result in the forfeiture of the deposit.
4.3. No-Show: If you fail to appear for your appointment without notice ("No-Show"), your deposit is forfeited, and we reserve the right to charge the full estimated session fee to the credit card on file to compensate the artist for lost time.
4.4. Lateness: If you arrive more than 20 minutes late, the artist reserves the right to cancel the appointment, and the deposit will be forfeited.

5. ELIGIBILITY AND SAFETY
5.1. Age Requirement: You must be at least 18 years old to be tattooed. A valid, government-issued photo ID (Passport or Driver’s License) is required at the time of the appointment.
5.2. Health Disclosure: You are required to complete a Release and Waiver of Liability form prior to the procedure. You must disclose any medical conditions, allergies, or skin conditions.
5.3. Zero Tolerance: We have a zero-tolerance policy for drugs and alcohol. If you arrive under the influence, the appointment will be cancelled immediately, and the deposit will be forfeited.
5.4. Healing: You acknowledge that the healing process varies by individual. We are not responsible for the outcome of the tattoo if aftercare instructions are not followed strictly.

6. INTELLECTUAL PROPERTY RIGHTS
6.1. Company IP: The "Tattoo Aspen" brand, website content, logos, and marketing materials are the exclusive property of TrudyLines.
6.2. Artist IP: The tattoo designs created by the artists remain their intellectual property. You are granted a license to wear the art for personal use. You may not reproduce the design for commercial purposes without the artist's written consent.
6.3. Media Release: By entering the studio, you consent to being photographed or filmed for marketing purposes (social media, press). If you wish to opt-out, you must inform us in writing upon arrival.

7. DISCLAIMERS THE SERVICES ARE PROVIDED "AS IS". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT A TATTOO WILL LOOK EXACTLY LIKE A REFERENCE IMAGE, AS SKIN IS A LIVING ORGAN AND RESULTS VARY. ARTISTIC VARIATIONS ARE TO BE EXPECTED.

8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY COLORADO LAW, TATTOO ASPEN BY TRUDYLINES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SERVICE.

9. INDEMNIFICATION You agree to indemnify and hold harmless the Company, its affiliates, and the artists from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your failure to disclose health issues, or your negligence regarding aftercare.

10. DISPUTE RESOLUTION AND CLASS ACTION WAIVER
10.1. Governing Law: These Terms are governed by the laws of the State of Colorado.
10.2. Arbitration: Any dispute arising out of or relating to these Terms or the Services shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Aspen, Colorado (or remotely if agreed).
10.3. Class Action Waiver: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
